Welcome to Trakte, operated by Abstrakte LLC dba Trakte (“Trakte,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile application, and last mile courier services (collectively, the “Services”).

By using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.


1. Eligibility

  • You must be at least 18 years old to use our Services.
  • By using our Services, you represent and warrant that you have the legal authority to enter into these Terms.

2. Services Provided

Trakte provides last mile courier and delivery solutions, including:

  • Pickup, transport, and delivery of goods.
  • Real-time tracking and delivery updates.
  • Proof of delivery (e.g., photo, signature, or digital confirmation).

We reserve the right to modify, suspend, or discontinue any Service at any time without prior notice.


3. User Accounts

  • To access certain features, you may be required to create an account.
  • You agree to provide accurate, current, and complete information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.

4. User Responsibilities

By using our Services, you agree:

  • Not to send prohibited items (see Section 17, Appendix A).
  • To ensure packages are properly labeled, packaged, and ready for delivery.
  • To comply with all applicable laws and regulations.
  • To provide accurate delivery details and contact information.

Trakte is not responsible for delays, failed deliveries, or additional costs resulting from inaccurate information or prohibited items.


5. Courier Responsibilities

Our couriers:

  • Are required to handle packages with reasonable care.
  • Will attempt delivery at the provided address. If unsuccessful, they may contact the recipient or return the package as per company policy.
  • May refuse to transport items that violate these Terms or applicable laws.

6. Payments and Fees

  • You agree to pay all applicable fees, charges, and taxes for the Services.
  • Payments are processed securely through authorized payment processors.
  • Fees are non-refundable except as required by law or explicitly stated in our refund policy.

7. Cancellations and Refunds

  • You may cancel a delivery request within a specified time window before pickup, subject to cancellation fees.
  • Refunds (if applicable) will be processed back to your original payment method.
  • Once a courier has picked up a package, cancellations are not permitted.

8. Limitations of Liability

To the fullest extent permitted by law:

  • Trakte is not liable for indirect, incidental, special, or consequential damages arising from use of our Services.
  • Our liability for lost, damaged, or delayed deliveries is limited to the lesser of:
    • The declared value of the package, or
    • A maximum liability cap set forth in our policies.
  • We are not responsible for delivery failures caused by incorrect addresses, natural disasters, strikes, accidents, or circumstances beyond our control.

9. Intellectual Property

All content, trademarks, logos, and materials provided through our Services are the property of Abstrakte LLC dba Trakte or its licensors. You may not copy, distribute, modify, or exploit them without prior written consent.


10. Privacy

11. Prohibited Conduct

You may not use our Services to:

  • Ship unlawful or restricted items.
  • Engage in fraudulent, abusive, or disruptive conduct.
  • Interfere with or damage our systems, servers, or networks.
  • Attempt to gain unauthorized access to any portion of the Services.

12. Termination

We may suspend or terminate your account and access to the Services at our sole discretion if you violate these Terms, misuse the Services, or for other legitimate business reasons.


13. Dispute Resolution

  • These Terms are governed by the laws of the State of Connecticut, without regard to conflict of laws principles.
  • Any disputes will be resolved through binding arbitration in Stamford, Connecticut, except where prohibited by law.
  • You waive the right to participate in a class action lawsuit.

We may update these Terms from time to time. If we make material changes, we will provide notice via our Services or other appropriate means. Continued use of our Services after updates constitutes acceptance of the revised Terms.

16. Service Level Agreement (SLA)

Trakte is committed to providing reliable and timely delivery services. The following Service Level Agreement (“SLA”) outlines our performance standards and customer remedies:

a. Delivery Commitments

  • Standard Deliveries: We aim to deliver within the time frame specified at booking.
  • Same-Day / Express Deliveries: Subject to availability, we strive to complete these within the stated service window.
  • Delays: Delivery times may vary due to traffic, weather, operational issues, or force majeure events.

b. Performance Standards

  • On-Time Delivery Rate: Trakte targets a minimum 95% on-time delivery rate.
  • Tracking Updates: Real-time tracking is available through our app/website.
  • Proof of Delivery: Couriers will capture delivery confirmation via signature, photograph, or digital verification.

c. Exclusions

This SLA does not apply to delays caused by:

  • Incorrect or incomplete addresses.
  • Absence of recipient or refusal to accept delivery.
  • Packages containing prohibited or restricted items.
  • Natural disasters, severe weather, accidents, labor strikes, or government restrictions.

d. Remedies

  • If Trakte fails to meet the delivery commitment due to reasons within our control, you may be eligible for:
    • Partial Refunds: A credit or refund of delivery charges.
    • Redelivery at No Extra Cost: Where feasible.
  • Remedies are limited to the fees paid for the affected delivery and do not cover consequential losses.

17. Appendix A – Prohibited and Restricted Items

The following categories of items are prohibited from shipment via Abstrakte LLC dba Trakte. Attempting to ship prohibited items may result in cancellation, refusal of service, return of shipment, or notification to authorities where required by law.

1. Illegal and Controlled Substances

  • Narcotics, illegal drugs, or drug paraphernalia
  • Cannabis, CBD, or related products (where prohibited by law)
  • Prescription medications (unless expressly permitted by law and authorized couriers)

2. Weapons and Hazardous Materials

  • Firearms, ammunition, explosives, or weapon parts
  • Knives, tasers, or other weapons prohibited by law
  • Hazardous or flammable substances (e.g., gasoline, lighter fluid, fireworks, chemicals)
  • Radioactive materials

3. Currency and Valuables

  • Cash, coins, or bearer negotiable instruments
  • Precious metals, gemstones, or bullion
  • Lottery tickets, gift cards, or prepaid debit/credit cards

4. Perishable or Biological Items

  • Perishable food, beverages, or frozen goods (unless specifically authorized)
  • Live animals, insects, or plants
  • Human remains, body parts, blood, or biological samples

5. Counterfeit or Unauthorized Goods

  • Counterfeit currency or goods
  • Unlicensed software, media, or pirated materials
  • Intellectual property–infringing items

6. Other Restricted Items

  • Tobacco products, e-cigarettes, or vaping devices
  • Alcoholic beverages (unless permitted by law and explicitly authorized by Trakte)
  • Items prohibited by applicable federal, state, or local laws
  • Any package that by its nature or packaging could cause injury, damage property, or delay operations

Enforcement

  • Trakte reserves the right to inspect, refuse, or dispose of prohibited shipments.
  • Shipping prohibited items may result in suspension or termination of your account.
  • Customers may be held liable for damages, fines, or legal claims arising from attempted shipment of prohibited goods.
